Terms and Conditions

Introduction**

These terms of use (the “Terms”) govern your use of the KickDrill mobile application (the “App”). The App is owned and operated by RST Consult AS. By accessing or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not access or use the App.

*2. Eligibility*

To use the App, you must have the legal capacity to enter into a binding contract.

*3. Account Creation*

To use the App, you must create an account. When you create an account, you will be required to provide us with certain information, such as your name or alias name, email address, and a self-generated password. You are responsible for maintaining the confidentiality of your account and password.

*4. Use of the App*

You agree to use the App only for lawful purposes. You agree not to use the App:

* In any way that violates any applicable laws or regulations.
* To send or receive any content that is illegal, offensive, or otherwise inappropriate.
* To impersonate any person or entity.
* To interfere with the operation of the App or any other user’s enjoyment of the App.

*5. User Content*

Any content that you post or share through the App is your own user content. You agree that you are solely responsible for your user content and that we are not liable for any user content.

*6. Indemnification*

You agree to indemnify and hold us harmless from and against any and all claims, damages, losses, and expenses (including attorneys’ fees) that arise out of or in connection with your use of the App.

*7. Limitation of Liability*

We are not liable for any damages, including but not limited to direct, indirect, incidental, special, or consequential damages, that arise out of or in connection with your use of the App.

8. Termination*

We may terminate your account and access to the App at any time, for any reason or no reason. Upon termination, you must cease all use of the App.

*9. Governing Law*

These Terms are governed by the laws of the country of Norway.

*10. Entire Agreement*

These Terms constitute the entire agreement between you and us with respect to your use of the App.

*11. Severability*

If any provision of these Terms is held to be invalid or unenforceable, such provision will be struck from these Terms and the remaining provisions will remain in full force and effect.

*12. Waiver*

No waiver of any provision of these Terms will be effective unless in writing and signed by both parties.
